If you have a CD, you have the rights to that music. If you make a copy of that CD, it’s okay. If you give away that CD, they don’t have the rights, so it is illegal. If you make a copy of that CD, then give away the original, your copy is illegal, because you no longer have the source rights.

What if you made a copy and then someone stole your original? Then who has the right to listen to the music and who has the illegal copy?

Technically, I believe that you would then have the illegal copy according to this. I think your friend would get in more trouble though if people found out that he was stealing your CD's, perhaps choose new friends.

That's true, but in which case I think the bigger problem here is that somebody broke into your house and stole your CD, not that you have a copy of it. Sorry, I know that is the point, and I am getting a bit off topic, but technically according to what you posted above, you would own the illegal copy.

I'd have to agree with you on that.. even though it seems a bit unfair that a burglar makes me a criminal because he's stealing my stuff.. But then again that's happened before eh? I recall a certain burglar who cut himself on a knife while in someone else's house, and sued the owner, and won! It's a mad, mad, mad, mad, mad world we live in lmao

You would still have a legal copy of the CD because you purchased the original. There is nothing illegal about creating a duplicate as a backup, same with DVDs.

yes but if you are not in possession of the original any longer, doesn't the backup copy become a copyright infringement because you have a copy of something you don't possess?

yarvaxea no because you still own the original copy even if it is no longer in your possession because it was stolen. the only problem here is if you can prove that you own the original.

that bs is posted by the riaa. the dmca act states making a backup copy is legal, and does not specify what media can or cannot be used. never quote from the riaa, or mpaa they are going to reword what the law says to suite there needs.

I don't know if lawyers would agree, but I believe that copying is ok as long as it's only used by the original owner. And of course it would be unethical to do something like copy a disc and then sell the original. Never do that.
