If I wanted to use a song or video clip and still be safe from legal issues under Fair Use, what guidelines would I have to follow? Does Fair Use apply only under educational videos or reviews, or does it matter what topic the video is?

You can only upload content that you own or have legal rights to upload.

Yes you can upload content without rights but you will just get banned one day it is not worth it.

I think as long as you are providing a commentary then it's fine. I've made thousands of dollars off of this on YouTube and my website. I'll use video clips from video games, images from other blogs, and other videos and music in my content to help show my audience things and provide a commentary.

I'm pretty sure you can use music or a song clip in a video if you're making no profit off it. Somebody correct me if I'm wrong, this is just guessing from my brief knowledge of Legal Studies.
